TERMS AND CONDITIONS OF USE FOR THE PAGO APP

Welcome to the Pago software application or the website identified by the URL: pago.ro (“Site”). Access to the Pago App, the Pago-Samsung App (as defined below), this Site, and the use of the services provided via the Site / App take place after you have been informed of the existence of the terms and conditions listed below ("Terms") and, in the case of accessing the App, following your opportunity to expressly accept them. In the absence of such acceptance, whether explicit or implicit, on your part, you may not use the Pago App and/or the Site. These Terms are intended to explain to you as clearly and transparently as possible how you may use the App and/or the Site. As such, this document is subject to ongoing changes and updates – we recommend that you review this document regularly to ensure you are aware of the most current version.
1. Definitions
In this document, capitalised terms shall have the following meanings:
a) “Pago App” or “the App” means the software application, to which the Company (as defined below) holds the rights, through which you can make online electronic payments to various service providers, available for you to download onto your mobile phone via the Apple App Store and Google Play directly, or via the Website by redirection, indirectly. For the purposes of these Terms, this definition shall apply regardless of how you access the Pago App (via the Website or using your mobile phone, directly from the Apple App Store or Google Play);
b) “Pago-Samsung App” means the software application, to which the Company (as defined below) holds the rights, through which (as defined below) you can connect to the Pago App and make online electronic payments to various service providers, available for you to download onto Samsung smart TVs via the Samsung Tizen Store. The Pago-Samsung App cannot be used without first configuring the Pago App, as provided for in these Terms, so that any reference to the Pago App shall also include a reference to the Pago-Samsung App, but references to the Pago-Samsung App must be understood strictly in relation to that app only;
c) "Company", "We" or "Our" means Timesafe S.R.L., a Romanian legal entity, with its registered office in Voluntari, registered with the Trade Register under no. J23/1658/2016, CUI 35968582;
d) "Third-Party Site Account" means your accounts and information on other websites or applications belonging to Approved Providers or the BT Pay Application (as these terms are defined below), outside the Pago Application, over which the Company has no rights and for the operation of which the Company cannot be held responsible. Insofar as connection to the App cannot be established using an Account from a Third-Party Site, we recommend that you check whether the Third-Party Site is experiencing connection issues before contacting the Company;
e) “CNAIR” means the National Road Infrastructure Administration Company, with its registered office in Bucharest, Sector 1, 38 Dinicu Golescu Street, registration number J40/552/2004 and CUI 16054368, tel. 021 264 32 47; as this information may change over time, we recommend that you visit the CNAIR website at http://www.cnadnr.ro/ for further information and to ensure that you have the latest identification and contact details for CNAIR;
f) “Personal Data” or “Personal Information” means any information relating to an identified or identifiable natural person; an identifiable person is a person who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to their physical, physiological, mental, economic, cultural or social identity, as defined in the General Data Protection Regulation (“GDPR”);
g) “Approved Supplier” means a legal entity included in the Pago App to which you may make payments via the functions of the Pago App. Approved Suppliers are listed in the App to the extent that the Company or one of its partners has a contractual relationship with them in this regard;
h) “BT Pay App” means the mobile application available for you to download onto your mobile phone via the Apple App Store and Google Play, operated and, unless otherwise stated, owned exclusively by Banca Transilvania S.A., a credit institution established in Romania, with its registered office in Cluj-Napoca, 8 George Barițiu Street, Cluj County, registered with the Trade Register under no. J12/4155/1993, tax identification number RO 502267, which features integration with the Pago App and allows you to use Our services without needing to access the Pago App;
i) "User" or “you” means any natural person over the age of 18 who registers for and uses the Pago App, accepting these Terms. For the avoidance of doubt, the Pago App is not intended for use by individuals who do not meet the conditions described in this definition and, explicitly, is not intended for use by minors (within the meaning of the legislation applicable to a particular User);
j) “Usage Fee” means the amount of money payable by you, in accordance with the provisions of Article 8 below, in order to use the Pago App in relation to the features you wish to have available within the Pago App;
k) “Donate with Pago” refers to a feature through which you or any other user of the Site has the opportunity to make donations to certain Non-Governmental Organisations (as defined below), as a result of campaigns run by the Company;
l) “Non-Governmental Organisation” means a non-profit non-governmental organisation, such as an association, foundation or federation, selected to participate in the “Donate with Pago” campaign, in accordance with the Regulations available here;
m) “Ghișeul.ro” means the platform administered by the Romanian Digitalisation Authority (a specialised public institution of the central public administration, with legal personality, under the Ministry of Communications and Information Society), through which users can pay taxes and fees set by the public institutions enrolled in the platform, as well as administrative fines;
n) ‘Rovinietă’ means the electronic registration of the user charge, which represents a specific amount the payment of which grants a vehicle the right to use, for a given period, the national road network in Romania, in accordance with the provisions of Government Ordinance 15/2002 on the application of the usage charge and the toll charge on the national road network in Romania, as subsequently amended and supplemented;
o) “Passage” means travelling, once in one direction, a distance on a section of road, bridge, tunnel or mountain pass, which forms part of the national road network in Romania, to which the toll applies; this toll represents a specific amount payable for a vehicle depending on the distance travelled on a section of road, bridge, tunnel or mountain pass forming part of the national road network in Romania, and on the type of vehicle;
p) “Benefit Voucher” means the coupon/voucher containing Pago Points purchased from the Benefit platform at the URL https://www.benefitsystems.ro and which may be used in the Pago App in accordance with these Terms.
q) “Partner” means any company with which Pago collaborates by integrating a feature into the Pago App, which enables Users to access the Partner’s application.
r) “Pago Points” represent a reward, in the form of virtual points associated with a User’s account, which that User may earn depending on the activities they carry out within the Pago App and in accordance with the Rules available here.
s) “MyCar” means the section within the Pago App where a User can configure details relating to one or more vehicles for which they wish to manage the validity dates of the Motor Vehicle Liability Insurance (RCA), Road Tax (Rovinieta), periodic technical inspection and/or border crossings associated with that vehicle or those vehicles, via the Pago App.
All other capitalised terms have the meaning stated when first used or, where applicable, first defined.
2. Use and Operation of the Pago App
2.1. Services offered via the App
The Company offers you, based on the user account created, access to the Pago App through which you can pay your bills, taxes, fees and make other payments to Approved Suppliers, either directly from the Pago App or from the BT Pay App, following the synchronisation of accounts on the two apps. For the avoidance of doubt, in the event that, following the synchronisation of accounts, you use the BT Pay App to access Our services, which are usually provided via the Pago App, such use is subject to the terms and conditions applicable to the BT Pay App, as made available by Banca Transilvania S.A.
The services provided via the Pago App are available to you only if you accept these Terms and may be used only after you have accepted these Terms. To the extent necessary, in accordance with legal provisions or the requirements of an authority, as well as on the basis of suspicions of fraud or compromise of its systems, the Company may ask you to prove the legitimacy of your status as a User by requesting the provision of additional information or documents. In this situation, the Company will not process the Personal Data contained in the additional information/documents provided except for the purpose of verifying the legitimacy of your status as a User.
Through the Pago App and/or the Website, the Company offers you access to the following services:
a) payment of bills to Approved Suppliers, using one of the following two methods: 1. setting up an Approved Supplier, in accordance with the provisions of Art. 2.2(f) below; 2. scanning an invoice received from a utility provider, provided that the provider is an Approved Supplier, without the configuration mentioned in the point above. This method does not apply to suppliers other than Approved Suppliers, with the exception of suppliers accessible if you have activated the Premium / Unlimited versions and have previously used the features described in Art. 8.2. lit. e) and 8.3. lit. e) of the Application, in which case payment of invoices relating to these providers will only be available in the situations mentioned above.
b) viewing the history of payments made to Approved Providers;
c) electronically topping up prepaid SIM cards, for cards associated with telephone numbers valid within Romania;
d) obtaining financial quotes for taking out a compulsory motor third-party liability insurance policy (RCA);
e) taking out an RCA policy;
f) receiving notifications sent by the Company regarding the expiry of the periodic technical inspection, RCA insurance (not CASCO), periodic servicing, and the Rovinieta (for one or more vehicles), based on the settings you have previously configured for this purpose;
g) obtaining financial quotes for taking out a travel medical insurance policy (travel insurance);
h) taking out a travel medical insurance policy (travel insurance);
i) paying, via the Ghișeul.ro platform, the taxes and duties set by public institutions for which you are liable;
j) paying a road tax;
k) paying the toll charge;
l) other services arising from these Terms
You have the option to access the Pago App’s services directly from the BT Pay App, following the synchronisation of your accounts on both apps.
Furthermore, in accordance with certain applicable legal provisions, as a User of the Pago App, you may also receive notifications sent by both the Company and CNAIR to the email address you have provided in the Pago App, regarding the expiry of the vignette’s validity period, based on the settings you have previously configured for this purpose.
2.2 User account
In order for you to benefit, under the best conditions, from the services described above, you must follow a specific set of steps:
a) download the Pago App from the Apple App Store or Google Play onto a phone compatible with the current version of the Pago App, as stated on the Pago App page in the Apple App Store or Google Play. The Company does not guarantee that the Pago App will work on every mobile device you own;
b) create a user account by completing a form containing the following fields: email address, surname, first name, password; when completing this form, you are required to provide accurate and complete information; if you do not complete the form, you cannot become a User of the Pago App; the purpose of the Company’s collection and processing of this information is described in the personal data processing policy (“Policy”), available here;
c) as an alternative to the step described in point b) above, you may use your Facebook account to log in to the App. In this case, the Company will process your Facebook username. If you are interested in further details regarding linking your Facebook account to other applications/websites, you can find more information here, here or here; you may also create a User account by accessing the unique link sent by another User, in accordance with the procedure described in Article 11 below;
d) as part of the process described in point b) above, accepting the Terms and confirming that you have been informed of the contents of the Policy; these documents are available for consultation at any time within the Application, following completion of the process described in point b);
e) selecting at least one of the payment types available within the Pago App, namely (1) payment of invoices relating to Approved Suppliers, or (2) payment for topping up a prepaid SIM card;
f) (optional, provided you do not opt for payment by scanning a bill in accordance with Art. 2.1(a)(ii) above) in the case of the action indicated in point (e)(1) above, selecting at least one Approved Supplier from the list available in the Pago App, organised according to the type of services offered (electricity, gas, water, waste collection, etc.) and entering the login details (username and password) that you use for your online account on the Approved Supplier’s app/website;
g) following completion of the action under point e), configuring each consumption point associated with each Approved Supplier selected and connected by you in the Pago App, by specifying the type of location (home, parents’ home, holiday home);
i) in the case of the action indicated in point e), clause (2), enter the telephone number associated with the prepaid SIM card you wish to top up;9. entering payment details (bank account number and one-time password, created within the Pago App) on the basis of which payment of invoices or top-ups is to be made. These details may be processed within the Pago App, in accordance with the Policy available here;
j) payment of the Usage Fee, in accordance with the provisions of Art. 8.4. below;
k) other actions specific to taking out MTPL and/or travel insurance, purchasing vignettes and/or paying the toll fee, making donations in accordance with Art. 4 of these Terms.
As a result of following the steps indicated above, the Company, via the Pago App, accesses and processes certain information held in your registered user account on the apps/websites belonging to Approved Providers. Access and processing are carried out in accordance with the provisions of the Policy, available here.
As a User, you are responsible for keeping the identification and login details associated with your user account secure, in order to prevent or reduce the likelihood of unauthorised access to the account created in the Pago App. For further information on this, please consult the Policy, available here.
To the extent that the Personal Data you provide when completing the registration form in the Pago App is false, inaccurate, or incomplete, the Company, upon discovering this, either directly or following a report, may cancel or temporarily suspend your access to the account or the operations carried out within that account, in whole or in part, or may refuse to provide any or all of the services available within the Pago App, to the extent that the relevant Personal Data cannot be rectified by the Company with your assistance.
In any event, the Company does not process Personal Data that is not necessary for the provision of the services available within the App, for which it has not obtained your prior explicit consent, or in relation to which it has no legitimate interest or other legal basis for processing.
2.3. Application Features
Whilst using the Pago App, you may at any time perform any of the following actions:
a) adding and removing Approved Suppliers from your account;
b) adding a bank card (i) via the Settings – My Cards menu; (ii) by entering your bank card details when making your first payment; or (iii) in the situation described in Article 9 below. The bank card added must be issued by a financial institution operating in Romania or within the European Union;
c) changing the details of the bank card you use to make payments;
d) accessing the Pago App settings, where you can find out more details about the Pago App; you can send written requests or questions to the Company; you can configure the types of notifications you wish to receive from the Pago App; you can set the payment security method (PIN or fingerprint); you can change the language in which the Pago App is displayed (Romanian or English);
e) viewing all invoices relating to the configured Approved Suppliers, in PDF format;
f) changing the tariff plan under which you use the Pago App, by switching to a higher or lower subscription, as applicable, to the extent that you wish to use more or fewer of the Pago App’s features;
g) integrating the App with Partners’ apps, so that Pago Users can access Partners’ platforms directly from the Pago App;
h) viewing and using Pago Points, in accordance with the terms and conditions available here.
i) logging out of the Pago App;
j) managing consent preferences for cookies, similar technologies and third-party SDKs integrated into the App by going to Settings → Cookie Preferences; details of the available processing categories are described in the Privacy Policy.If, whilst using the Pago App, you notice any issues that may indicate the Pago App is not functioning properly, you can report this to the Company by sending an email to support@pagoplateste.ro or by using the “Have your say” section within the Pago App.
As a User, you bear full responsibility for all operations carried out via the Pago App. In return, the Company guarantees that it processes the data you generate within the Pago App, including Personal Data, in accordance with the provisions of the Policy, available here.
The Company sends marketing push notifications — regarding the services, features or offers of the Company or its Partners — exclusively to Users who have given their consent for the “marketing” category via the consent management panel within the App (see Privacy Policy, Section 3.8). If this consent is withdrawn, the Company will cease sending marketing push notifications until consent is given again.
2.4. Payment of Invoices
For the avoidance of doubt, the Company is not responsible for the accuracy of the information contained in the PDF invoices available within the Pago App, belonging to Approved Suppliers, such as, without limitation, the amount due and its due date, the correct description of the place of consumption or the contract holder for the place of consumption. For any queries or discrepancies regarding this information, the Company will direct you to the Approved Supplier that issued the bill.
Within the payment history section for each Approved Supplier, you can view the status of all invoices paid in the last 6 months, find the contact details of the Approved Suppliers’ customer service departments, or request a resend of a payment confirmation for an invoice, provided that payment was previously made using the Pago App. This resending is done via your email.
You can pay one or more bills at the same time, up to the maximum number of bills available for payment each month, based on the subscription you have activated within the App. If the maximum number of invoices available for payment in a single month is reached, when you attempt to pay a new invoice, the App will display a message informing you that the limit has been reached, suggesting the option to activate another subscription within the App, along with further details about the available features and the price of the proposed tariff plan.
If you have not added a bank card to your account via the Settings – My Cards menu, when you initiate your first payment, you will be asked for your bank card details, which will subsequently be saved by the payment processor used by the Company at the relevant time. Confirmation of a payment is displayed within the App and via a confirmation email sent to you.
The Company does not process your bank card details in any way other than to facilitate access to this information for the payment processor. Further details on this can be found in the Policy available here.
We use third-party products to process payments (“Payment Processors”) made from your account within the App. Payment processing may be subject to the terms, conditions and privacy policies of the Payment Processors, in addition to these Terms. We are
not liable for any errors that may arise in connection with the processing of a payment. You agree to make the payment using the payment method selected at the time you instruct a payment. The Company does not guarantee any specific time frame that may elapse between any of the operational steps of the Pago App, as described in this Article.
The Company cannot be held liable for technical difficulties that may arise depending on the mobile device on which the Pago App is running and the capabilities of that device. The Company welcomes your feedback and requests that you report any issues with the operation of the Pago App, which can be sent by email to: suport@pagoplateste.ro or via the “Have your say” section within the Pago App.
2.5. Insurance
Services for obtaining quotes and taking out MTPL policies and travel medical insurance policies (travel insurance) are provided in accordance with the specific terms and conditions of these services, available here.
2.6. Paying for a vignette
You can pay for road tax via the App for vehicles registered in Romania or abroad (excluding motorcycles or vehicles with temporary registration). To pay for road tax via the App, you must provide the following details: vehicle registration number, chassis number, vehicle category, and country of registration. If at least one of these details is missing, we will notify you with the message “Incomplete Details”, and as long as this message is active, you will not be able to pay for the Rovinieta. You can choose from all types of vignettes available in Romania (namely, for 1 (one) day, 7 (seven) days, 30 (thirty) days, 90 (ninety) days or 12 (twelve) months. However, please note that, in accordance with current legislation, you will not be able to purchase a 1-day vignette for passenger cars and goods vehicles with a maximum authorised mass (MAM) of 3.5 tonnes or less.
You will not be able to pay for the Rovinieta via the App in the following cases:
* there is already an active Rovinieta for the same vehicle, the period of which overlaps by at least 1 (one) day with the period of the Rovinieta you wish to purchase;
* the start date of the validity of the vignette you wish to purchase is more than 30 (thirty) calendar days from the current date.
Information regarding the start and/or expiry date of a vignette purchased via the App will be available both within the App and in the confirmation email we send you when you purchase the vignette.
If you wish (and select this option), we will send you notifications to the email address provided when you purchase the vignette via the App, to inform you of the expiry of the vignette purchased via the App.
If you opt for this feature, in addition to the notification mentioned above, CNAIR will also send you notifications to the same email address to inform you of the expiry of the validity period of the vignette purchased via the App. This communication is necessary in view of the applicable legal provisions and our contractual relationship with CNAIR. Further details regarding this processing of your email address can be found in the Policy, available here.
Payment for the Rovinieta will be made by debiting the bank card saved in the App or a new bank card added to the App, without us charging any commission for this transaction. Following the purchase and payment of your first Rovinieta, you will receive 100 Pago Points, which you can use for future transactions, in accordance with the Terms and Conditions available here.
2.7. Payment of the Toll
You can pay the Toll via the App for a vehicle registered in Romania or abroad (excluding motorcycles or vehicles with temporary registration). You can pay for 1 (one) Crossing, 2 (two) Crossings or 20 (twenty) Crossings, and the number of Crossings does not vary depending on the type of vehicle. Please note that the App does not track used or remaining Crossings under any circumstances, so we are unable to inform you of the number of remaining valid Crossings or the number of Crossings used. Instead, you will have access to the history of transactions/payments you have made via the App.The validity of Crossings (whether 1 (one) Crossing, 2 (two) Crossings or 20 (twenty) Crossings) is 12 (twelve) months from the date of payment of the fare for the respective Crossing.Payment of the fee for a Pass will be made by debiting the bank card saved in the App or a new bank card added to the App, without us charging any commission for this transaction. Upon payment for the first number of Crossings (whether 1 (one) Crossing, 2 (two) Crossings or 20 (twenty) Crossings), you will receive 50 Pago Points, which you may use in subsequent transactions, in accordance with the Terms and Conditions available here.
3. Use and Operation of the Pago-Samsung App
The Company offers you, based on the account previously created within the Pago App, access to the Pago-Samsung App, through which you will have access only to a portion of the services offered by the Company within the Pago App, as described in this Article.The services provided via the Pago-Samsung App are available to you only if you accept these Terms and may be used only after you have accepted these Terms. To the extent necessary, in accordance with legal provisions or the requirements of an authority, as well as on the basis of suspicions of fraud or interference with its systems, the Company may ask you to prove the legitimacy of your status as a User by requesting the provision of additional information or documents.
3.1. Services within the Pago-Samsung App
To use the Pago-Samsung App, you must follow a specific set of steps, as follows: 1. Download the Pago-Samsung App from the Samsung Tizen Store onto a television compatible with the current version of the Pago-Samsung App, in accordance with the information on the Pago-Samsung App page in the Samsung Tizen Store. Thus, the Company does not guarantee that the Pago-Samsung App will work on every television you own; 2. log in with the user account created in accordance with Article 2.2(b), or create a user account by providing the details specified in Article 2.2(b); 3. as part of the process described in point b) above, to accept the Terms and confirm that you have been informed of the contents of the Policy; these documents are available for consultation at any time within the Pago-Samsung App, following completion of the process described in point b);4. to install / have installed the Pago App on your mobile phone and to configure / have configured the Pago App, in accordance with Article 2 of the Terms;5. to connect the Pago-Samsung App with the Pago App on your mobile phone; To do this, you will need to enter the code generated on your Samsung TV in the Settings – My Account menu of the Pago App on your mobile phone.Through the Pago-Samsung App, you will only have access to paying bills to Approved Suppliers configured within the Pago App on your mobile phone, in accordance with the provisions of Article 2.2(f) above. To pay a bill, you must have a bank card added to the Pago App on your mobile phone, in accordance with the provisions of Articles 2.3(b) and 2.4 above.
3.2. Features of the Pago-Samsung App
Whilst using the Pago-Samsung App, you can perform any of the following actions at any time:1. view the Approved Suppliers in your account, added to the Pago App, and certain details regarding these Approved Suppliers (payment history, overdue invoices), as well as consumption charts;2. view the history of payments made to Approved Suppliers;3. view all invoices relating to your configured Approved Suppliers in PDF format;4. sort invoices relating to your configured Approved Suppliers;5. access the Pago-Samsung App settings, where you can select the default bank card to be used for paying invoices to Approved Suppliers; you can read the Terms and Conditions and Privacy Policy; you can find out more about security measures; you can find out more details about the Pago-Samsung App; you can set the payment security method (PIN); you can change the language in which the Pago-Samsung App is displayed (Romanian or English); 6. log out of the Pago-Samsung App. For the avoidance of doubt, all other services/features offered by the Company, as set out in Article 2 of the Terms (such as, without limitation, adding an Approved Supplier, adding a bank card, changing bank card details, modifying the tariff plan, etc.) will only be accessible via the Pago App on your mobile phone. All other provisions of Article 2 above, relating to the use and operation of the Pago App, also apply to the use and operation of the Pago-Samsung App, insofar as they relate to the services mentioned in this Article and do not conflict with the provisions of this Article.Furthermore, the effects of using the services/features offered by the Company via the Pago-Samsung App will be reflected in the user account within the Pago App.
4. The “Donate with Pago” feature
The Company offers you, based on the user account created in the Pago App, as well as to any other persons who do not have a user account and merely access the Website, the opportunity to use the Donate with Pago feature and to donate to a non-governmental organisation.
4.1. Accessing the feature by you, as a User
Within the Pago App, you may at any time perform any of the following actions:1. make a donation to a Non-Governmental Organisation;2. set up recurring donations to a Non-Governmental Organisation;3. to change the settings for recurring donations (i.e., to stop recurring donations to a specific Non-Governmental Organisation and, if necessary, to set up recurring donations to another Non-Governmental Organisation);Furthermore, within the Pago App, you also have access at any time to the following features:1. viewing the profiles created for each of the 15 Non-Governmental Organisations selected in the campaign, including, but not limited to, description, contact details, location, financial targets, activities carried out, and the history of donations received via Pago;2. view the history of donations made to the Non-Governmental Organisations; 3. the option to share on social media; 4. the option to make an anonymous or non-anonymous donation. Donations you make to a Non-Governmental Organisation can consist of cash or Pago Points, which are automatically converted into cash. If you donate sums of money, the minimum amount that can be donated is 5 RON. For donations exceeding 2,500 RON, processing will be done manually and the donation will be sent to the Non-Governmental Organisation only after its approval. If the Non-Governmental Organisation does not accept the donation, the Company will refund the amount to you or to the user of the Website who made the donation, as applicable.Donations made by you to a Non-Governmental Organisation via the Pago App are not taken into account when calculating the number of bills paid monthly under your subscription, in accordance with Article 8 below.If you set up a recurring donation to a Non-Governmental Organisation, you will receive the following benefit: you will be able to pay two additional bills each month on top of the number included in your selected subscription plan, in accordance with Article 8 below. This benefit will be active for every month in which at least one recurring donation has been made.
4.2. Access to the feature by Website users
The ‘Donate with Pago’ feature is also available to Site users (regardless of whether or not they are Pago App users and whether or not they have created a user account). A Website user may make a donation to a Non-Governmental Organisation. A donation made in this way may consist solely of a sum of money and must be at least 5 RON. In order to make such a donation, the Website user will be asked to provide their bank card details, which will be transmitted to the Payment Processor; the provisions of Article 2.4, paragraphs 5–7, shall apply accordingly. Once a donation has been made by a Website user, they will receive confirmation of the donation by email. Furthermore, the user in question will also receive a number of Pago Points, in accordance with the Terms and Conditions available here. Pago Points will only be awarded if the user in question does not already have a user account in the Pago App and only if they create a user account via the link sent to them.
4.3 The relationship between donors, Non-Governmental Organisations and the Site
When a monetary donation is made via the Pago App or via the Website, the money paid by you or the Website user will be transferred to the Company’s bank accounts, which will subsequently transfer it to the bank account of the Non-Governmental Organisation to which the donation was made. For the avoidance of doubt, the Non-Governmental Organisations authorise the Company to receive donations on their behalf. As such, in this case, the Company acts solely as an agent of the Non-Governmental Organisations and, in this capacity, the Company receives the money from you or from the Website user. For clarity, the Company is not and does not act as a payment processor, a bank or any other type of financial institution.Both you and the Site user understand and agree that, in providing this functionality, the Company is merely an intermediary and is not a party to the donation agreement between you or the Site user and the Non-Governmental Organisations to which money or Pago Points are donated. For clarity, the Company is a third party to this legal relationship (donation agreement) and we are not liable at any time for any claim, damage, payment, deficiency, fine, judgment, debt, loss, cost or expense arising from or related to the legal relationship between you or the Site user and the Non-Governmental Organisation. The Company makes no warranties and no representations regarding the Non-Governmental Organisations or their activities. The Company cannot be held liable for the manner in which the Non-Governmental Organisations use the donations received from you or the Site user. Any dispute regarding the use of donations by Non-Governmental Organisations or any other matters relating to donations made shall be resolved directly and strictly between the donors (you or the user of the Site) and the recipients (the Non-Governmental Organisations).
5. The “Ghișeul.ro” feature
The Company offers you the opportunity to use the Ghișeul.ro feature, through which you can pay the taxes and duties set by state institutions for which you are liable.
To use the Ghișeul.ro functionality, you must follow a set of steps:
1. have an account previously created on Ghișeul.ro, in accordance with the Ghișeul.ro terms and conditions;
2. enter your surname, first name and Personal Identification Number (CNP) in the Pago App. Access to and processing of this information, as Personal Data, is carried out in accordance with the provisions of the Policy, available here;
3. to pay the taxes and fees owed by you, as indicated in your account on the Ghișeul.ro platform, you will need to select the payment obligation you wish to settle within the Pago App;
4. when you choose to make a payment as per point c), you will be redirected to the payment page on the Ghișeul.ro mobile version;
5. you will make the payment on the payment page of the Ghișeul.ro mobile version;
6. For payments made on the payment page of the Ghișeul.ro mobile version, for data security reasons, you will not be able to use the details of any of the bank cards previously saved in the Pago App and used for other features of the Pago App;
7. After making the payment, you will receive a payment confirmation at the email address registered in your Ghișeul.ro account;
8. The payment confirmation will be saved in the Pago App so that it is available in the payment history within the Pago App.
The payment of taxes and duties via the Ghișeul.ro functionality is carried out within the Ghișeul.ro platform and is subject to the terms, conditions and privacy policies of the Ghișeul.ro platform, in addition to these Terms. For clarity, such payments are processed by Ghișeul.ro; the Company is not involved in any way in the processing of the payment or the transfer of funds to government institutions.
The taxes and duties displayed in the Pago App are those indicated in your account on the Ghișeul.ro platform; the Company does not intervene in any way regarding these.
The Company is not liable for any error, damage or loss that may arise in connection with the fees and taxes displayed in the Pago App, as indicated in your account on the Ghișeul.ro platform. Furthermore, the Company is not liable for any errors, damages or losses that may result from the payment processed via the Ghișeul.ro platform.
6. Integration with other applications
6.1. Integration with the BT Pay App
The Company offers you the opportunity to use its services via the BT Pay App. To synchronise with the BT Pay App, you must follow these steps:
1. have an account previously created in the BT Pay App, in accordance with the terms and conditions of the BT Pay App;
2. enter, within the BT Pay App, the unique User code and the email address used to create the account for the Pago App. The unique User code can be accessed in the Settings > My Account section of the Pago App and is valid for 15 minutes, refreshing automatically after this period. For the avoidance of doubt, the unique User code is not the same as the unique account code available in the Invite section, as described in Article 11.
Access to and processing of the unique User code and email address within the BT Pay App, as Personal Data, are carried out by Banca Transilvania S.A. in accordance with Banca Transilvania S.A.’s personal data processing policy, which can be accessed here.
Upon integration with the BT Pay App, carried out in accordance with this Article, the user account configuration from the Pago App will be imported, comprising the list of Approved Suppliers and the payment history from the Pago App. This configuration will be automatically updated between the accounts in the two apps each time a payment is made to Approved Suppliers existing in the Pago App at the time of integration with the BT Pay App. You will be able to view the history of payments made to Approved Suppliers regardless of whether they were initiated via the BT Pay App or the Pago App, in either of the two apps.
Following integration, you will only be able to add new Approved Suppliers within the Pago App, by following the steps described in Art. 2. Approved Suppliers added after integration will not be automatically synchronised in the BT Pay App, and you will only be able to initiate payments to them following a manual update/synchronisation of the two apps, carried out in accordance with this Article.
Payments made via the BT Pay App, following synchronisation with the Pago App, are subject to the terms, conditions and privacy policies of the BT Pay App, in addition to these Terms. For clarity, such payments are processed in accordance with the terms and conditions of the BT Pay App, and the Company is not involved in any way in the processing of the payment or the transfer of funds to their recipients.
By way of exception, for certain Suppliers, User payments initiated via BT Pay will continue to be processed by Pago (e.g. Gaz Vest, RER Ecologic Service București Sud, Apa Nova, BNP Paribas PF, Benefit Seven, Credex IFN, Xisoft Servicii). Payments to these Approved Suppliers remain subject to these Terms even when initiated via the BT Pay App.
The ability to make payments via the BT Pay App does not affect the permissions for using the features of the Pago App, as set out in Article 8 “Subscriptions”.
You may choose to delete any of the accounts you hold on the Pago and BT Pay Apps at any time. Deleting your account from the Pago App does not result in the deletion of your payment history or the configuration of Approved Suppliers within the BT Pay App, so you will still be able to use the services of this app.
6.2. Integration with Partner applications
6.2.1. The Company offers you the opportunity to play the Lotto via the application of the Partner ELECTRONIC SKILLS SRL (“AmParcat”) as follows:
a. You can access the Lotto function within the Pago App;
b. When you access the Lotto feature in the Pago App, you will be redirected to the AmParcat app, where you can play Lotto under the terms set by the Partner;
c. If a Pago User accesses the Lotto feature and does not have a customer account in the AmParcat app, or has an account created with a different email address (from the one used to create the account in the Pago App), they will be redirected to download and install the AmParcat app.
Any activities related to the Loto game made available to Pago Users via the Pago interface will be facilitated by AmParcat and will be the sole responsibility of the Partner. For clarity, Pago will not provide Users with any assistance or support regarding the Loto game within the AmParcat app or any claims arising therefrom, but will only provide access to the AmParcat platform via the Pago Interface.
Access to and processing of personal data within the AmParcat App are carried out by AmParcat in accordance with AmParcat’s personal data processing policy, which can be accessed here.
Access to and use of the AmParcat App are provided by the Partner in accordance with its terms and conditions, which can be accessed here.
ELECTRONIC SKILLS SRL and Timesafe SRL are separate companies; they are not affiliated and are not responsible for the products/services offered by the other.
6.2.2. The Company offers you the opportunity to obtain a loan through the 123 Credit Opportunity Solutions SRL (“123credit”) application.
Any activities related to the lending service made available to Pago Users via the 123credit interface will be facilitated by the 123credit Partner and will be the sole responsibility of the Partner. For clarity, Pago will not provide Users with any assistance or support regarding the lending service within the 123credit app or any claims arising therefrom, but will merely provide access to the 123credit platform via the Pago Interface.
Also for clarity, Pago shall have the right to add to the Pago Application and make available to Users the option to make payments in instalments or use other payment methods, through specific products made available, directly or indirectly, by financial or credit institutions.
Access to and processing of personal data within the 123credit App are carried out by 123credit in accordance with 123credit’s personal data processing policy, which can be accessed here.
Access to and use of the 123credit app are provided by the Partner in accordance with its terms and conditions, which can be accessed here.
123 Credit Opportunity Solutions SRL and Timesafe SRL are separate companies; they are not affiliated and are not responsible for the products/services offered by the other. Credit
intermediation services via 123credit are provided exclusively by 123 Credit Opportunity Solutions.
6.2.3. The Company offers you the opportunity to access the services of the Partner PROPTECH CORP SRL (“Milluu”).
Any activities related to the services made available to Pago Users via the Milluu interface will be facilitated by the Partner Milluu and will be the Partner’s sole responsibility. For clarity, Pago will not provide Users with any assistance or support regarding Milluu’s services or any claims arising therefrom, but will merely ensure access to the Milluu platform via the Pago Interface.
Access to and processing of personal data within the Milluu application are carried out by Milluu in accordance with Milluu’s personal data processing policy, which can be accessed here.
Access to and use of the Milluu application are provided by the Partner in accordance with its terms and conditions, which can be accessed here.

7. Accessing and Updating Accounts on Third-Party Sites
By using the Pago App and accepting these Terms, you expressly authorise the Company to access any of your Accounts on a Third-Party Site on your behalf, in accordance with the provisions of the Policy, available here.
By using the Pago App, you may automate, in whole or in part, the payments you authorise to Approved Suppliers. In order to optimise your use of the Pago App, so that you can be certain that the payment amounts displayed in the Pago App are accurate and complete, the Company periodically accesses and updates the information about you available in Accounts on Third-Party Sites.
Apart from the purpose specified in Art. 9, the Company will not use the information about you available in Accounts on Third-Party Sites for any other purpose.
You understand that, to the extent that the information about you available in the Accounts on Third-Party Sites is inaccurate, incomplete or inadequate, there is a possibility that the Pago App may not display the correct and complete information regarding invoices relating to Approved Suppliers. For the avoidance of doubt, the Company is not liable for any erroneous results, to the extent that such results are caused by any incorrect information concerning you held in Accounts on Third-Party Sites. You understand that you are responsible for keeping the information available in Accounts on Third-Party Sites up to date.
8. Subscriptions
The Pago App may be used free of charge or in exchange for a Usage Fee, depending on the features you wish to access.
8.1. Free Version
In the Free version of the Pago App, you can:
a) make a maximum of 4 (four) monthly bill payments to Approved Suppliers;
b) top up prepaid SIM cards electronically an unlimited number of times;
c) take out an unlimited number of motor vehicle liability insurance policies, regardless of their value, the identity of the insurance company with which they are taken out, their duration, or whether they cover one or more vehicles, subject to the specific terms and conditions for taking out motor vehicle liability insurance policies available here;
d) take out an unlimited number of travel medical insurance policies (travel insurance), regardless of their value, the identity of the insurance company with which they are taken out, their duration or whether they are taken out for one or more persons, subject to the specific conditions for taking out travel insurance policies described here;
e) payment of a vignette, subject to the terms of section 2.6 of these Terms;
f) payment of the toll charge, subject to the terms of section 2.7 of these Terms;
g) performing any other operations within the App that are not exclusively available to Users who have activated the Premium or Unlimited versions of the App.
8.2. Premium Version
In the Premium version of the Pago App, you can:
a) make a maximum of 8 (eight) monthly bill payments to Approved Suppliers;
b) make an unlimited number of electronic top-ups of prepaid SIM cards;
c) take out an unlimited number of motor vehicle liability insurance policies, regardless of their value, the identity of the insurance company with which they are taken out, their duration, or whether they are taken out for one or more vehicles, subject to the specific conditions of the motor vehicle liability insurance policy issuance process described here;
d) take out an unlimited number of travel medical insurance policies (travel insurance), regardless of their value, the identity of the insurance company with which they are taken out, their duration, or whether they are taken out for one or more persons, in accordance with the specific conditions of the travel insurance policy issuance process described here;
e) request the addition of a new supplier to the Pago App, a supplier not listed among the Approved Suppliers, by submitting a photo of an invoice issued by that supplier, whereupon We shall add them to the Pago App so that they are available solely for the payment of invoices via the invoice barcode scanning function, within 10 (ten) working days from the time the photo of the invoice is submitted to the Pago App. The data contained in this invoice will be processed by the Company solely for the purpose described in this paragraph and in accordance with the provisions of the Policy, available here;
f) make payments to suppliers added to the Pago App by you or other Users, in accordance with the procedures described in point (e);
g) configure the receipt of alerts regarding the expiry of the following validity periods, for an unlimited number of vehicles: periodic technical inspection, Casualty and Collision (CASCO) insurance, periodic servicing, and the fee for using the national road network in Romania (Rovinietă). You can configure this by entering the expiry date of the validity periods indicated above and by setting the number of days before the expiry date on which you wish to receive a notification within the App regarding this expiry;
h) receive 50% more Pago Points for each transaction carried out within the App for which Pago Points are awarded, in accordance with the Terms and Conditions available here, with the exception of those specified in points 2.1.12. – 2.1.14 of the Terms and Conditions, to which this sub-clause (h) shall not apply;
i) receive priority responses from the Company regarding requests you have submitted to the Company, regardless of the channel through which they are submitted. In this regard, the Company undertakes to respond as a priority to Users who activate the Premium version, as opposed to Users who activate the Free version, without, however, guaranteeing a maximum response time to these requests (the time will depend on the number and complexity of requests from Users who activate the Premium and Unlimited versions);
j) payment of a road tax, subject to the terms of section 2.6 of these Terms;
k) payment of the toll charge, subject to the terms of section 2.7 of these Terms;
l) performing any other operations within the App that are not exclusively available to Users who have activated the Unlimited version of the App.
8.3. Unlimited Version
In the Unlimited version of the Pago App, you can:
a) make an unlimited number of monthly bill payments to Approved Suppliers;
b) top up prepaid SIM cards electronically an unlimited number of times;
c) take out an unlimited number of motor insurance policies, regardless of their value, the identity of the insurance company with which they are taken out, their duration, or whether they are taken out for one or more vehicles, subject to the specific conditions of the motor insurance policy issuance process described here;
d) take out an unlimited number of travel medical insurance policies (travel insurance), regardless of their value, the identity of the insurance company with which they are taken out, their duration, or whether they are taken out for one or more persons, in accordance with the specific conditions of the travel insurance policy issuance process described here;
e) request the addition of a new supplier to the Pago App, a supplier not listed among the Approved Suppliers, by submitting a photo of an invoice issued by that supplier, whereupon we shall add them to the Pago App so that they are available solely for the payment of invoices via the invoice barcode scanning function, within 10 (ten) working days from the time the photo of the invoice is submitted to the Pago App. The data contained in this invoice will be processed by the Company solely for the purpose described in this paragraph and in accordance with the provisions of the Policy, available here;
f) make payments to suppliers added to the Pago App by you or other Users, in accordance with the procedures described in Art. 8.2(e) and 8.3(e);
g) configure the receipt of alerts regarding the expiry of the following validity periods, for an unlimited number of vehicles: periodic technical inspection, comprehensive insurance (CASCO), periodic servicing, and the fee for using the national road network in Romania (Rovinietă). This can be configured by entering the expiry date of the validity periods indicated above and by setting the number of days prior to the expiry date on which you wish to receive a notification within the App regarding this expiry;
h) receive twice as many Pago Points for each transaction carried out within the App for which Pago Points are awarded, in accordance with the Regulations available here, with the exception of those indicated in points 2.1.12. – 2.1.14. of the Regulations, to which this sub-clause (h) shall not apply;
i) the payment of a vignette, subject to the terms of section 2.6 of these Terms;
j) the payment of the toll charge, subject to the terms of section 2.7 of these Terms;
k) to receive priority responses from the Company regarding requests you submit to the Company, regardless of the channel through which they are submitted. In this regard, the Company undertakes to respond as a priority to Users who activate the Unlimited version, as opposed to Users who activate the Free or Premium versions, without, however, guaranteeing a maximum response time to these requests (the time will depend on the number and complexity of requests from Users who activate the Unlimited plans);
l) suggestions regarding new features requested for the App, received from Users who have activated the Unlimited subscription, will be treated as a priority, without this imposing on the Company an obligation to implement these suggestions or a maximum timeframe for implementing these features.
8.4. Usage Fee
Depending on the subscription chosen from those indicated in Articles 8.1, 8.2 and 8.3, you will be required to pay a Usage Fee as follows:
a) to access the Free version of the App, you will not be required to pay any Usage Fee;
b) to access the Premium version of the App, you will need to pay a Usage Fee of 87.99 RON per year (i.e. 7.33 RON per month), if you pay in advance for 12 months’ use of the Premium version, starting from the day the payment is made, or 9.49 RON per month, if you make this payment monthly;
c) to access the Unlimited version of the App, you will need to pay a usage fee of 259.99 RON per year (i.e. RON 21.67 per month), if you pay in advance for 12 months’ use of the Unlimited version, starting from the day the payment is made, or RON 27.99 per month, if you pay monthly.
If, on 2 June 2025, you have already paid a Usage Fee lower than the amount described in this Article 8.4, based on a subscription whose validity extends beyond 2 June 2025, then that Usage Fee remains applicable until the expiry date of the relevant subscription. After expiry, the fees set out in Article 8.4 will apply to you, depending on the subscription you have chosen. If the User chooses not to renew a subscription after its expiry, they will continue to use the Free version of the Application, retaining the right to activate a subscription in accordance with these Terms at any time in the future.
8.5. Payment of the Usage Fee
To pay the Usage Fee, you will be asked to enter the details of the bank card you wish to use for payment. You may change these bank card details at any time following the initial setup. You will also be able to use Pago Points held in your account within the App to pay part or all of the Usage Fee.
Furthermore, apart from entering your bank card details when making your first payment, you will be able to add and save a bank card to your account by accessing the Settings – My Cards menu. If you choose to add a bank card in this way, the bank card will be debited with a non-refundable amount of 0.2 RON, for the purpose of verifying the bank card and saving it to your account.
For the avoidance of doubt, the non-refundable amount of 0.2 RON is debited only if you add a bank card via the Settings – My Cards menu. This amount will not be debited if the bank card is entered at the time of the first payment.
The Company reserves the right to amend the Usage Fees set out in Article 8.4 above, which will apply from the next payment. In this case, the Company will inform you in writing within the App and via the email address provided when you created your account in the App, regarding the date from which the new Usage Fees will apply. For the avoidance of doubt, unless otherwise provided in these Terms, the new Usage Fees shall not apply to billing cycles in progress on the date on which the new Usage Fees become applicable.
In the case of the Premium and Unlimited versions of the App, once you have selected one of these versions, you will have a period of 15 (fifteen) calendar days during which you may unilaterally terminate, for any reason, the relationship established with the Company regarding the use of the version you have activated. By terminating the agreement unilaterally within the period indicated above, you will not be obliged to make any payment of a Usage Fee to the Company. For the avoidance of doubt, following the expiry of the unilateral termination period indicated in this Article, you will owe the amounts specified in Article 8.4 above, as applicable.
When selecting the Premium or Unlimited version of the App, if you have not added a bank card to your account via the Settings – My Cards menu, you will need to enter the details of the bank card with which you wish to pay the Usage Fee, in accordance with Article 8.4 above. If the Company is unable to debit the bank card provided, upon expiry of the 15 (fifteen) calendar day period indicated in the previous paragraph, with the amount of the Usage Fee corresponding to the version of the App you have chosen, the Company will send you a notification by email, using the email address you provided when setting up your user account, informing you of this inability and requesting that you enter the details of another bank card. If you do not enter the details of another bank card within 24 hours of the Company sending the notification, the Free version of the App will be automatically activated within the App until you enter the details of a bank card that can be debited by the Company.
Upon the conclusion of the billing cycle for the version of the App for which you have paid the Usage Fee, a new billing cycle, of the same duration as the initial one, will commence, and the Usage Fee for this new cycle will be automatically debited from the account associated with the bank card you have entered into the App for payment of the Usage Fee. This process will be repeated at the end of each billing cycle until you express a wish to use a different version of the App, in which case the terms and conditions applicable to that version will apply, as described in this document with reference to the respective version (Free, Premium, Unlimited), starting from the end of the current pricing cycle relating to the Usage Fee most recently paid by you / debited directly from the account associated with the bank card you entered in the App for payment of the Usage Fee.
Deleting your account from the App will result in the cancellation of the automatic debit from the bank card account you entered in the App for payment of the Usage Fee, for the amount representing the Usage Fee you have opted for.
At any time whilst using any of the App’s versions, you may express your wish to use a different version of the App. If you are using one of the App’s versions for which the Company charges a Usage Fee (Premium or Unlimited) and wish to use the Free version of the App, this option will be recorded within the App and will take effect from the day following the end of the billing cycle for the version you are currently using, based on the Usage Fee you have paid. For the avoidance of doubt, the Company will not refund any part of the Usage Fee you have already paid at the time you choose to use the Free version of the App.
9. Using the Benefit Voucher
The Pago Points associated with the Benefit Voucher (in the amount stated on the voucher) will be credited to the user account in the Pago App corresponding to the email address you provided when purchasing the Benefit Voucher.
If no user account exists with that email address, an information email (inviting the person to create a user account) will be sent to the email address provided at the time of purchasing the Benefit Voucher. Once the user account has been created using the email address provided at the time of purchasing the Voucher, the Pago Points associated with the Benefit Voucher (in the amount stated on the voucher) will be allocated to that User.
You understand and agree that the value of a Benefit Voucher and/or the number of Pago Points accumulated may be determined solely by the operator of the website https://www.benefitsystems.ro and configured by you, as a user of that website, without Us being able to influence this process in any way. Pago
Points accumulated in accordance with this Article may be used in the Pago App in accordance with the terms and conditions available here.
Pago Points accumulated in accordance with this Article may only be used in the Pago App after adding a bank card to the Pago App; this step is technically necessary, even if you intend to make a payment in the Pago App using only the Pago Points in question. The data relating to this card will be processed in accordance with the Policy available here, without us withdrawing any money from this card.

10. Fingerprint authentication
Fingerprint authentication can be used on devices that have built-in fingerprint authentication, specifically iPhone 5S or later with iOS 8 or later, and on devices running Android 6.0 or later. The company does not process in any way the fingerprint details stored on your devices; this is used solely to activate algorithms within the Pago App that enable your authentication.
This type of authentication provides the level of security permitted by the provider of this authentication solution. Further details regarding fingerprint authentication can be found:
a) for iOS operating systems here.
b) for Android operating systems here.
The Company accepts no liability and makes no recommendation regarding the use of this type of authentication over the PIN-based authentication system, or vice versa.
You understand that you are solely responsible for the use of fingerprint authentication and the consequences of any unauthorised access using this type of authentication.
11. The Pago App’s recommendation system to your contacts
The Company will generate a unique alphanumeric code (consisting of numbers and letters), which will be associated solely with you and which you may share with your contacts in your phone book and/or within other mobile applications installed on your mobile device. For the avoidance of doubt, you are under no obligation to share this unique code, and sharing this unique code will not result in the activation of any features of the Pago App that are unavailable without sharing this unique code, except for those described in this Article 11.
In connection with the sharing of the unique code associated with your account in the Pago App, you will receive a number of Pago Points (in accordance with the terms and conditions available here), provided that you carry out the following actions cumulatively:
a) share the unique code associated with your account in the Pago App with your contacts;
b) one of your contacts installs the Pago App after clicking on the link you shared, which contains the unique code associated with your account in the Pago App;
c) following the installation of the Pago App as per point (b) above, the new User sets up at least one Approved Supplier within the Pago App and verifies their account by entering their phone number, followed by entering the code received via SMS on that phone number, as a result of the specific action carried out in the App;
d) makes a payment for an invoice to that Supplier.
The unique code associated with the account in the Pago App is available in the ‘Invite to Pago’ section and can be shared with any and all of your contacts. In the case of new Users who have only carried out the actions indicated in points (a) and (b) of this paragraph, as the User who shared their unique code (which led to the installation of the App by the new Users), you will be able to see, within the ‘Invite to Pago’ section, that the new Users have not paid an invoice and you will be able to send them notifications from the Pago App.
Failure to validate the User’s account in accordance with point (c) above does not prevent the new User from making payments via the Pago App, but only prevents them from receiving and using Pago Points to pay for the services available in the Pago App.
12. Changes to the Terms
The Terms may be amended at any time by the Company. Whenever we make changes, we will notify you of this when you access the Pago App and will request your express consent to accept these Terms.
You will be able to access the latest version of the Terms within the Pago App at any time.
13. Limitation of Liability
The Company makes every effort to keep the App operational. However, for technical reasons or due to technical updates, the App may not function at certain times. In such situations, the Company will inform you of this when you access the App.
In any event, the Company shall not be liable, under any circumstances, for any direct or indirect damage or for any direct or indirect loss of profit suffered as a result of the use or interruption of the services provided by the Pago App.
Payments made via the Pago App are processed in accordance with the information in the notification displayed by the App following the completion of a payment. Each payment is recorded with the date on which the payment was made by you, regardless of the date on which the amount is received by the recipient Authorised Supplier or by the Company (in the case of payment of the Usage Fee). The Company shall not be liable for any loss or damage that may arise from delays in payments made via the Pago App or as a result of the Pago App malfunctioning due to circumstances beyond its control.
The Pago App provides answers to frequently asked questions that may arise from using the App. You may also contact the Company at any time whilst using the App to ask questions regarding any aspect of the App. In this context, the Company shall not be liable for any losses caused by the improper use of the Pago App.
Where our Services are accessed via the BT Pay App, responsibility for the provision and continuity of the Services lies entirely with Banca Transilvania S.A., regardless of whether payments initiated via the BT Pay App are processed by Banca Transilvania S.A. or by our Company. If you have any questions regarding the provision of the Services via the BT Pay App, you will need to contact Banca Transilvania S.A. directly.
14. Governing Law and Dispute Resolution
These Terms and any contractual obligations arising from or in connection with them shall be interpreted in accordance with the laws of Romania. The Romanian courts shall have exclusive jurisdiction to settle any dispute relating to the use of the Pago App and these Terms.
15. Third-party websites
The Pago App and the Website contain links to other websites, for whose content the Company is not responsible. Access to these websites is subject to the terms and conditions of each website. The Company accepts no liability for the content of these websites.
16. Intellectual property
The Company owns all rights to the content of the Pago App and the Website (including, without limitation, images, text, trademarks, logos, web graphics, scripts, applications and databases). It is prohibited to use any content relating to the Pago App and/or the Website without the Company’s prior written consent.
